Summary
Agreement: By using educraft, you agree to these Terms of Service. You must be at least 18 years old and use the Service only for lawful educational purposes.
Service: educraft provides an AI teaching assistant for NCEA teachers. The Service uses OpenAI's technology to generate educational content and integrates with Google Classroom for feedback generation. We do not guarantee accuracy or completeness of AI-generated content.
Your Account: You are responsible for maintaining account security and all activities under your account. You must provide accurate information and notify us of unauthorized access.
Content Ownership: You own the content you create. We retain ownership of our platform and technology. You grant us a license to use your content to provide and improve the Service.
Payment: Subscription fees are processed securely through Stripe and billed in advance. You may cancel anytime with a 3-day money-back guarantee on all plans for any reason (measured from purchase to refund email sent). Plan changes are prorated for same billing intervals but not for different intervals. Fees are generally non-refundable after 3 days except as required by New Zealand law. We never store payment information on our servers.
Prohibited Uses: You may not use the Service for illegal activities, to generate harmful content, violate intellectual property rights, or interfere with the Service. Violations may result in account termination.
Limitations: The Service is provided "as is" without warranties. Our liability is limited to the maximum extent permitted by New Zealand law. Consumer guarantees under the Consumer Guarantees Act 1993 cannot be excluded.
Termination: You may cancel your account anytime. We may terminate accounts that violate these Terms. Upon termination, your access will cease and data will be deleted within 90 days.
Governing Law: These Terms are governed by New Zealand law. Disputes will be resolved through negotiation, mediation, or New Zealand courts. Your consumer rights are protected under New Zealand law.
1. Acceptance of Terms and Agreement
Welcome to educraft. These Terms of Service ("Terms") constitute a legally binding agreement between you and educraft governing your access to and use of our AI-powered teaching assistant service (the "Service") accessible at https://educraft.co.nz and https://app.educraft.co.nz.
By using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service. These Terms apply to all users. We reserve the right to modify these Terms at any time; material changes will be communicated as described in Section 14.
2. Definitions
Key terms: "Service" means the educraft platform and all related features; "User Content" means content you create or generate through the Service; "AI-Generated Content" means content generated by AI technology (including OpenAI); "Subscription" means a paid plan.
3. Description of Service
educraft provides an AI-powered teaching assistant for NCEA teachers in New Zealand, helping educators create curriculum-aligned teaching materials. The Service includes AI-powered content generation, NCEA curriculum alignment, customizable templates, content editing, export options, content storage, and feedback generation integrated with Google Classroom.
3.1 Service Limitations
The Service uses third-party AI technology (OpenAI) and may contain inaccuracies or errors. You are responsible for reviewing and editing all AI-generated content before use. The Service may be unavailable due to maintenance, technical issues, or third-party disruptions. We do not guarantee error-free, uninterrupted service or that it will meet all your requirements.
3.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We are not liable for any modification, suspension, or discontinuation.
4. User Accounts and Registration
4.1 Account Requirements
To use the Service, you must be at least 18 years old, have legal capacity to enter agreements, and be a teacher or educator with a legitimate educational purpose. You must provide accurate information, maintain account security, and accept responsibility for all activities under your account. You may not create multiple accounts, share your account, or transfer it to others.
4.2 Account Security
You are solely responsible for maintaining account security, including using a strong password, not sharing credentials, logging out on shared devices, and reporting unauthorized access immediately. We are not liable for losses arising from your failure to maintain security.
4.3 Account Verification
We reserve the right to verify your identity and eligibility at any time. Failure to provide requested verification may result in account suspension or termination.
5. Acceptable Use and Prohibited Activities
You agree to use the Service only for lawful educational purposes. You are solely responsible for your conduct and any Content you create or share.
5.1 Acceptable Use
You may use the Service for creating educational materials, generating NCEA curriculum-aligned content, preparing teaching materials, and professional development purposes.
5.2 Prohibited Activities
You agree NOT to: (1) use the Service for illegal, fraudulent, or unauthorized purposes; (2) generate harmful, offensive, discriminatory, or objectionable content; (3) infringe intellectual property or privacy rights; (4) attempt unauthorized access to our systems or other users' accounts; (5) interfere with, disrupt, or damage the Service; (6) scrape, mine, or reverse engineer the Service; (7) use the Service for commercial purposes beyond your educational role; (8) impersonate others or provide false information; (9) share your account or circumvent usage limits; (10) upload malicious code; or (11) generate content that violates educational standards or promotes academic dishonesty.
5.3 Content Responsibility
You are solely responsible for reviewing, verifying, and editing all AI-generated Content before use. AI-generated Content may contain errors and must comply with applicable laws and educational standards. We are not responsible for the accuracy, completeness, or suitability of AI-generated Content.
5.4 Enforcement
Violations may result in immediate account suspension or termination, legal action, and reporting to authorities. We reserve the right to investigate violations and cooperate with law enforcement.
6. Content and Intellectual Property Rights
6.1 Ownership of User Content
You retain all ownership rights to User Content you create, generate, upload, or provide through the Service (including slides, prompts, modifications, and original content). You are solely responsible for your User Content and represent that you have all necessary rights to use it.
6.2 Ownership of Service
We retain all ownership rights to the educraft platform, software, technology, designs, trademarks, and documentation. Nothing in these Terms grants you any rights to our intellectual property except the limited license to use the Service.
6.3 License Grant to Us
By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, host, and analyze your User Content to provide, operate, and improve the Service. This license continues after you stop using the Service, except where deletion is required by law. You may revoke by deleting your account, subject to data retention policies.
6.4 License Grant to You
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial educational purposes. This does not include the right to resell, modify, reverse engineer, or remove proprietary notices from the Service.
6.5 Intellectual Property Infringement
If you believe Content infringes your rights, contact us with a detailed notice. We will investigate and take appropriate action. You agree not to use the Service to infringe others' rights. We may remove infringing Content and terminate repeat infringers' accounts.
7. AI Technology and Third-Party Services
7.1 Use of OpenAI Technology
Our Service uses AI technology provided by OpenAI. We do not claim ownership of OpenAI's technology. By using our Service, you also agree to comply with OpenAI's Terms of Service. When you generate content, your prompts and generated content are processed through OpenAI's systems. We do not share your personal identifying information with OpenAI, but content is processed per OpenAI's Privacy Policy. We are not responsible for OpenAI service disruptions or changes.
7.2 AI-Generated Content Disclaimers
AI-generated Content may contain errors, inaccuracies, or biases and may not align perfectly with NCEA standards. You are solely responsible for reviewing, verifying, and editing all AI-generated Content before use. We do not guarantee accuracy, completeness, or suitability. AI-generated Content should not substitute for professional judgment or educational best practices.
7.3 Third-Party Services
The Service may integrate with third-party services (payment processors, cloud hosting, analytics, email, support tools). Your use of these services is subject to their terms and policies. We are not responsible for third-party services, their availability, or their policies.
7.4 Google Classroom Integration
Our feedback generation feature allows you to connect your Google Classroom account. To use this feature, you must grant us access to your Google Drive. Important: We only access documents, drives, and files specifically related to Google Classroom submissions for the purpose of generating feedback. We do not access, view, or process any other files or data in your Google Drive or Google account. Your use of Google Classroom integration is subject to Google's Terms of Service and Privacy Policy. You can revoke access at any time through your Google account settings.
8. Payment Terms and Subscription
8.1 Subscription Plans
We offer monthly and annual subscription plans. Fees are billed in advance and automatically renew unless cancelled. We may change pricing with at least 30 days' notice; price increases apply to subsequent renewals, not your current period. All fees are in NZD and exclude taxes (GST will be added as required).
8.2 Payment Processing
We accept credit/debit cards and other payment methods. By providing payment information, you authorize us to charge your payment method. Payment information is securely processed by Stripe (we never store payment information on our servers). Failed payments may result in subscription suspension; we'll notify you and may retry payment.
8.4 Cancellation and Refunds
You may cancel your subscription at any time through your account settings or by contacting the refund manager at rumiawais@gmail.com. Cancellation takes effect at the end of your current billing period, and you will continue to have access to the Service until that time.
8.4.1 3-Day Refund Policy
We offer a 3-day money-back guarantee on all subscription plans. If you're not satisfied with the Service for any reason within the first 3 days of your initial payment, you may request a full refund. This policy applies to all plans and all customers. The 3-day period begins from the time of purchase and ends when your refund request email is sent to us.
8.4.2 Refund Processing
Refund requests must be submitted in writing to the refund manager at rumiawais@gmail.com within the applicable refund period. Approved refunds are processed within 10-14 business days and will be credited back to your original payment method. We will send confirmation once the refund has been processed on our end. Please note that it may take additional time for our billing provider (Stripe) to reflect the refund in your account, depending on their processing times.
8.4.3 No Refunds After 3 Days
Subscription fees are generally non-refundable after the 3-day refund period, except as required by New Zealand law (Consumer Guarantees Act 1993) or for billing errors. This applies to all recurring payments and plan upgrades.
8.4.4 Plan Changes and Prorating
Upgrades and Downgrades: You may upgrade or downgrade your subscription plan at any time through your account settings. Plan changes take effect immediately.
Prorating for Same Billing Interval: When changing between plans with the same billing interval (e.g., monthly to monthly, or annual to annual), we prorate the charges. You'll only pay the difference for the remaining period of your current billing cycle.
No Prorating for Different Billing Intervals: When switching between plans with different billing intervals (e.g., from monthly to annual, or annual to monthly), no prorating applies. The new plan will begin immediately, and you'll be charged the full amount for the new billing period.
8.4.5 Exceptions to Refund Policy
Refunds may be granted outside the standard 3-day policy in exceptional circumstances, such as:
- Service unavailability due to our technical issues lasting more than 24 hours
- Billing errors on our part
- Requirements under the Consumer Guarantees Act 1993
All exceptions are evaluated on a case-by-case basis and require written approval from our team.
8.5 Subscription Changes
You may upgrade or downgrade your plan at any time. Changes take effect immediately or at the start of your next billing period, with pricing prorated accordingly.
9. Service Availability and Support
9.1 Service Availability
We strive for high availability but cannot guarantee 100% uptime. The Service may be unavailable due to scheduled/unscheduled maintenance, technical issues, third-party disruptions (OpenAI, hosting, payment processors), network problems, force majeure events, or security incidents. We'll make reasonable efforts to notify you of planned maintenance but are not liable for unavailability.
9.2 Customer Support
Support is available via email at rumiawais@gmail.com, phone at 022 569 2631 (business hours), and in-app help documentation. We aim to respond within 24-48 hours during business days (Monday-Friday, 9:00 AM - 5:00 PM NZST) but don't guarantee specific response times. Support channels and hours may change.
9.3 Service Level Objectives
We do not provide SLAs or guarantee specific uptime. Our service level objectives are targets, not guarantees.
10. Warranties and Disclaimers
10.1 Service Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED SERVICE, ERROR-FREE OPERATION, ACCURACY OF CONTENT, AND SECURITY OF INFORMATION.
10.2 Consumer Guarantees Act 1993
NOTHING IN THESE TERMS LIMITS YOUR RIGHTS UNDER THE CONSUMER GUARANTEES ACT 1993 OR OTHER APPLICABLE CONSUMER PROTECTION LAWS. If you are a consumer, the Service comes with guarantees of acceptable quality, fitness for purpose, and matching descriptions. If the Service fails to meet these guarantees, you may be entitled to remedies including repair, replacement, or refund.
10.3 AI Content Disclaimers
AI-generated Content may contain errors, inaccuracies, or biases. We do not warrant the accuracy, completeness, or educational value of AI-generated Content. You are solely responsible for reviewing and validating all AI-generated Content before use. It should not substitute for professional judgment or educational best practices.
11. Limitation of Liability
11.1 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDUCRAFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL) ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE, ERRORS IN CONTENT, UNAUTHORIZED ACCESS, SERVICE INTERRUPTIONS, OR THIRD-PARTY SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM, OR NZD $100, WHICHEVER IS GREATER.
11.2 Exceptions
These limitations do not apply to liability that cannot be excluded under the Consumer Guarantees Act 1993, liability for death/personal injury caused by our negligence, fraud, or other liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify and hold harmless educraft from all claims, damages, losses, and expenses (including attorneys' fees) arising from your use/misuse of the Service, violation of these Terms or laws, infringement of third-party rights, or your User Content. We reserve the right to assume defense of any matter subject to indemnification.
13. Termination and Account Closure
13.1 Termination by You
You may terminate your account anytime by contacting the refund manager at rumiawais@gmail.com or using account deletion features. Termination cancels your subscription at the end of your current billing period unless you request immediate termination.
13.2 Termination by Us
We may suspend or terminate your account immediately without notice if you violate these Terms or laws, engage in fraudulent/harmful activities, pose a security risk, fail to pay fees, breach warranties, or if required by law. We may also suspend accounts temporarily while investigating violations.
13.3 Effects of Termination
Upon termination: your access ceases immediately; your subscription is cancelled; you lose access to account and User Content; we delete/anonymize your data per our Privacy Policy (typically within 90 days); no refunds except as required by law; and provisions that should survive (Intellectual Property, Warranties, Liability, Indemnification, Governing Law) will survive.
13.4 Data Export
You may export your User Content before termination. We recommend exporting before requesting deletion. We are not responsible for data loss after termination.
14. Changes to Terms and Service
14.1 Modification of Terms
We may modify these Terms at any time. We'll update the "Last updated" date and notify you of material changes by email or prominent notice. We'll provide at least 30 days' notice before material changes take effect where required by law. Your continued use after changes become effective constitutes acceptance. If you don't agree, you must stop using the Service before changes take effect.
14.2 Modification of Service
We may modify, suspend, or discontinue any aspect of the Service at any time with or without notice. We are not liable for any modification, suspension, or discontinuation.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by New Zealand law. Disputes will be subject to the exclusive jurisdiction of New Zealand courts.
15.2 Dispute Resolution
We encourage informal resolution first. If unsuccessful: (1) parties will negotiate in good faith for 30 days; (2) parties may agree to mediation; (3) either party may commence legal proceedings in New Zealand courts.
15.3 Consumer Rights
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or other applicable consumer protection laws. Your consumer rights cannot be excluded by agreement.
15.4 Class Action Waiver
To the maximum extent permitted by law, disputes will be resolved individually, not through class actions.
16. Force Majeure
We are not liable for failures or delays due to circumstances beyond our reasonable control, including natural disasters, war, pandemics, strikes, internet/telecommunications failures, third-party service failures, cyberattacks, or changes in laws. If a force majeure event continues for more than 30 days, either party may terminate these Terms.
17. General Provisions
Severability: If any provision is invalid or unenforceable, the remaining provisions remain in effect, and the invalid provision will be modified or severed as necessary.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement and supersede all prior agreements relating to the Service.
Waiver: Our failure to enforce any provision doesn't constitute a waiver. Any waiver must be in writing and signed by us.
Assignment: You may not assign these Terms without our written consent. We may assign these Terms without your consent, including in connection with a merger or sale of assets.
